Socialist Brian Moore Gains Court Victory in MS "Ten minute too late" case

On December 18, the 5th circuit issued an opinion in Moore v Hosemann, 09-60272, the case filed by Socialist Party presidential candidate Brian Moore last year, when the Mississippi Secretary of State refused to accept his presidential elector paperwork because it was submitted at 5:10 p.m. on the filing deadline. The Secretary of State rejected the paperwork because it arrived ten minutes after he had closed his office. The building itself was still open, so the paperwork had been left at the door of the Secretary of State’s office.

On March 10, 2009, the U.S. District Court had ruled against Moore, saying the case is moot. The District Court said, “It does not seem reasonably likely that other prospective presidential candidates will fail to timely file their qualifying papers before the Secretary of State’s office closes at 5 p.m. on the date of the qualifying deadline.”

But, the 5th circuit disagreed, saying, “The Secretary has made it plain that he intends to enforce the 5 p.m. deadline in future elections. He adds that the chance is very small that Moore or any other presidential candidate will miss the deadline again. That is beside the point, however. As long as the complained-of deadline is in place, future candidates in Mississippi will be subject to it and will need to conform to its demands. Thus, the effects of the deadline will persist.”

Therefore, the case goes back to the U.S. District Court, to settle the main issue. Moore’s case depends on the fact that Mississippi election laws do specify an hourly deadline for some kinds of paperwork. However, the law governing filings of presidential electors does not mention an hourly deadline, so the implication is that if the paperwork comes in on the deadline day at any hour, it is timely. The 5th circuit opinion also says that the U.S. District Court should refer the case to the Mississippi state courts, because generally, federal courts do not interpret or construe the actual meaning of state laws; that is a job for state courts. Therefore, probably a state court will eventually make the decision as to whether Moore’s paperwork should have been accepted.

The decision is by Judge Jerry Smith, a Reagan appointee, and is co-signed by Judge Edith Jones, another Reagan appointee, and Judge Harold DeMoss, a Bush, Sr. appointee. This is the first time the 5th Circuit has issued an opinion favorable to a minor party or independent candidate since 1996, when it invalidated a Texas law requiring independent candidate petitions to include the voter registration affidavit number of each petition signer. That case was Texas Independent Party v Kirk, 84 F.3d 178.

 

Robert Moon writes "Obama exposed as former member of a socialist party"

As reported by Newsbusters, The American Thinker and Politically Drunk with Power, web archives have now confirmed that Barack Obama was indeed a registered member of a radical socialist organization called the "New Party" in 1996.

The group was established by the Democratic Socialists of America to help push socialist candidates over the top in winnable elections. Multiple far left publications have now expressly identified Barack Obama as one of New Party's official candidates for state senate in 1996 (see here and here).

Perhaps this is why he has been so extremely over-sensitive about the "S" word, even going as far as to blacklist journalists for drawing parallels.


To which former (2003-2006) State Secretary Atlee Yarrow for the Socialist Party of Florida replies 12/15/09:

 Democratic Socialists of America is a political action committee according to fec.gov and does not run candidates for office because it cannot do so legally. Secondly, your piece does not mention the state law on fusion ballots. New Party does not and never has defined itself as socialist in any way. There are two actual socialist parties in the USA, the SP-USA and the SWP of which Obama has never been a member and never spoke at a single meeting. Most likely he never would because he is a center thinking capitalist. The argument here is weak and stupid as being equal to saying "Obama might be a national socialist because he is half white." This information furthermore is so old that it came up in 2007. Welcome to 2010 in a few days, have you been asleep?

Some Houston toy drives check immigration status

They don't claim to know who's been naughty or nice, but some Houston charities are asking whether children are in the country legally before giving them toys.

In a year when more families than ever have asked for help, several programs providing Christmas gifts for needy children require at least one member of the household to be a U.S. citizen. Others ask for proof of income or rely on churches and schools to suggest recipients.

The Salvation Army and a charity affiliated with the Houston Fire Department are among those that consider immigration status, asking for birth certificates or Social Security cards for the children. READ MORE CLICK HERE

"Radical Change Needed for All" states Brian Moore

St. Petersburg Times, Hernando Edition, December 2, 2009 The recent letter (Nov. 26, 2009) saying better days are ahead and the letter writer defending himself as a blind optimist reminds one of what most critics say of those of us who are promoting socialism in America. They say we are naive, grasping at windmills and unrealistic of how the world operates.
However, the shoe now fits on the other foot. What the writer says is true, that life spans are longer, homes are bigger, food is more affordable and more education available. But that is not true for everyone, and each day fewer and fewer Americans have such a luxury or such a privilege.
I am not thankful for where our country is today, or where we, as a nation, are going. I can understand the writer’s limited and false perspective, though, because he is relatively secure in his retired lifestyle. He must have multiple pensions, excellent health insurance and probably has never experienced the insecurity of looking for a job, much less losing gainful employment after many years of steady work.
I too am optimistic, but my optimism is not blind, it is based on a belief that by radically altering our economic system we will be able to survive as a nation and for more people (i.e. the entire population) to share in the benefits of full health, housing, employment and education, all as a right, and not as an economic privilege.

War Protest Draws New & Different Responses

The Nature Coast Coalition for Peace and Justice, conducted another of its antiwar demonstrations on Saturday, November 28, after a hiatus of four to six months, and discovered "new and different responses" from the passing cars and public.
 
The "hate for Bush was no longer there," said Jerry Cox, 52, an antiwar protester from spring Hill, and, he added, "more people seemed to be in opposition" to the ongoing wars in Iraq and Afghanistan.  Cox referenced the fact that two drivers stopped their cars on the side of the road, in front of the protesters, to lend their verbal support and encouragement.  He felt that was "quite significant and a new change." 
 
On the other hand, several incidences of passersby attacking Obama and the protesters verbally occurred, with one person yelling from his truck to "Kill Obama, kill the nigger," and several others gesturing vulgarly with their middle fingers.   Were they Republicans or Democrats?   
 
The mix of reactions occurred during the one and one-half hour demonstration, by nine peace group members, at the corner of U.S. Highway 19 and State Road 50, directly across the street from the Weeki Wachee Spring Park, on a cold Saturday morning, with temperatures in the 40's.
 
Scap Gregory, a long-time retired WAC and military veteran, dating back to1948, and a Homosassa resident, also participated with the group and observed that "the protest seemed less interesting than before, with a more quiet opposition to both the war and to the war protesters coming from both sides."  Ms. Gregory also said "our protest group was also smaller."   However, Mr. Cox observed that "more Democrats and others who have remained neutral on President Obama will come out to protest more after the president's speech this coming Tuesday, (assuming Obama will report on the troop increase for Afghanistan)."
 
Ginger Wielk, another demonstrator, from Spring Hill, said, "Overall, the pubic responses were very positive, plus, it felt good to be out there again, and [she] looks forward to the next war protest!"
 
Brian Moore, Chair of the local Nature Coast Coalition for Peace and Justice, said "he was pleased overall with the public's positive response Saturday to "our side-of-the-highway" protest group, as well as the "degree of interest by peace group members to reactivate opposition to the two ongoing wars."
 
No press or media attended the Saturday morning event, but Moore said there was a "different response than usual" by the local press earlier in the week.  He observed that the more traditional conservative-leaning Hernando Today newspaper, who seemed less public on the peace group's efforts during the Bush years, "published an informative article" on the upcoming protest Thursday.  This was also followed up by WWJB local radio's news reports, on the upcoming demonstration.   The local activist then added that the the more liberal-leaning St. Petersburg Times, who traditionally published notices on the peace group's events, many times with only one day notice, "did not have any report" this week, despite a four-day lead time. 
 
Moore also observed that earlier this week the main section of the St. Petersburg Times reported "in its inside pages" about Obama increasing the troop level for Afghanistan by 34,000 new soldiers, while most papers nationwide reported it as front page news; then, the following day, the newspaper placed "a front-page" news report "on the difficulties of President Obama's decision with so many interest groups involved."  Moore wondered "if the change in emphasis, by both newspapers, was coincidental or intentionally partisan.

Unprepared for Economic Chaos

Socialist activist Brian Moore warned a group of mostly public school teachers, college professors and attorneys, in the small audience, of the dangers of nations not prepared for severe economic crises causing governmental collapse.  The speaker further warned that such a state of affairs could bring on unwanted social and political conditions resulting in countries being controlled by dictators, without the rule of law, and the loss of basic freedoms.

 
The former presidential candidate for the Socialist Party USA, was the invited speaker before a Tampa, Florida group of "Center For Inquiry (CFI)" members, 15 participants in all, last Saturday morning, November 21st, at the Bridgeport Office Center-5201 W Kennedy Blvd., in Tampa, Florida.
 
The Florida resident and civic activist, in his remarks, addressed the advantages of socialism and the growing failures of capitalism.  He included the history of how American socialism developed from the late 19th century to its present day 21st century operations, and how "legitimate radical thought in America has suffered the consequences." 
 
Moore also was very critical of the two major political parties in the United States, especially their dependence on corporate and special interest power and money.  Many in the audience, who were Democrats, challenged the speaker on the importance of "working within the system, as a Democrat," and not being "such a romantic by tilting at unrealistic and unreachable windmills."  These same Democrats expressed fear of a socialist society "being run by tea-party people."
 
Moore not only criticized the American political system but also the fourth estate as well, and its allegiance to the status quo.  He blamed the media and the press for embracing traditional institutions, and for unfairly protecting the two major parties by labeling minor and independent political parties as irrelevant based on their lack of access to money, few resources, along with advocating untraditional or radical ideas.   Moore listed all the social advances the Socialist Party advocated starting right before the beginning of the 20th century that were eventually embraced by both the Democrats and the Republicans (an 8-hour work day, a 6-day work week, child labor laws, woman's suffrage, unemployment insurance, workers compensation, social security, etc.).
 
The antiwar activist and national health advocate also integrated into his presentation the analogy of the Spanish Civil War, 1936 to 1939, as to the dangers of relying on a government in a weak economic situation.  Once the Spanish economy collapsed, forces from those in power lost credibility, thereby enabling an opposing power to emerge in a struggle. 
 
The newly established leftist government at the time, was dependent on leftist power groups, such as radical unions, socialist and communist political parties, and peasant workers from the farms and countryside of a large agrarian society.  However, when the weakened national economy collapsed, the rightwing, made up of the more traditional landowners, the military, fascist political parties and the Catholic Church made a grab for control as the vacuum of power increased.   After three years of bloodshed and anarchy, and the loss of democratic rule, the rightwing ultimately won the day.  The victor's leader turned out to be a rightwing military dictator by the name of General Francisco Franco, who aligned himself with Adolf Hitler of Germany and Mussolini of Italy.  Even the United States aligned with Franco's side, at the time, out of fear of the left. 
 
Moore's point was that for a society to rely on the status quo, no matter how poor the economic condition (i.e. its reliance on capitalism), and its efforts to work within the traditional system, did not prevail.  The Spanish nation did move to a more radical economic and political change, albeit late, in order to prevent the national economy to collapse.  However, the opposing traditional economic forces interceded, thus causing chaos, civil war, and the ultimate loss of democratic rights and freedoms.
 
Moore says, he "fears the same situation could occur in America, if we are not prepared!"
 
Moore spoke of both the "Red Terror,"  and the "White Terror," that occurred during those three bloody civil war years in Spain.  Both sides, the left and the right, where guilty of atrocities and massacres and justified the loss of basic freedoms.  The Hernando County resident said that each side justified its dictatorial behavior based on the rights of power, and not on principle, or fairness or even truth.
 
Former candidate Moore warned his audience that this same fate could await the United States of America.  "A watershed is about to occur from a Great Depression or deep recession," he stated.  The traditional forces are "still relying on an outmoded 16th century economic system," Moore exclaimed, that puts its faith in a "free market" philosophy that is "not based on logic," but on illogical risk, and opportunities for the privileged few, at the expense of the many. 
 
Moore said to the thoroughly engaged audience that now is the "crucial moment" for American society to develop alternative plans, to "embrace more radical ideas," with new economic and political systems, that are based on more sound socialists' principles and a non-profit economic system based on social services, communal responsibility and control over the means of the right kind of production.
